Services are available globally, except in regions with payment restrictions.

4. Payment Terms
Services may be subscription-based (monthly) or one-time purchase.
All billing is in USD and processed via approved third-party payment providers.
No demos are offered, but we ensure client satisfaction with each engagement.
Refunds are not generally available unless specifically agreed in writing.
Payment obligations are non-cancelable once a billing period or purchase is in effect.
5. User Responsibilities
Use MindSpark AI services lawfully and ethically.
Do not misuse, abuse, or attempt unauthorized access to systems, data, or accounts.
Respect intellectual property; do not submit content you do not have rights to.
Maintain confidentiality of your own login and account access.
Follow any fair use or API use limitations communicated by us.
6. Company Rights
MindSpark AI (at the CEO’s and company’s discretion) reserves the right to:
Suspend, limit, or terminate service to any user for any reason, including violations of these terms.
Modify, discontinue, or restrict services at any time.
Update service offerings and pricing, notifying users in advance where possible.
7. Intellectual Property & AI Output
All software, AI models, content, and technology used by MindSpark AI are proprietary and owned by the company.
Users maintain access to their own submitted data but grant MindSpark AI a license to use such data for providing and improving services.
All AI outputs, tools, dashboards, and results are the property of MindSpark AI. Users are granted a limited, non-transferable license solely for the intended business or personal use.
Users may not copy, distribute, or resell MindSpark AI content or technology.
8. Data & Privacy
Use of services is governed by our Privacy Policy.
MindSpark AI may process and store data for service functionality and improvement.
Upon account or service termination, information is removed from active use and placed in secure, archived storage.
9. Disclaimers and Limitation of Liability
MindSpark AI provides all services “as-is” and makes no warranties regarding accuracy, fitness for purpose, or expectations of results.
We are not liable for any indirect, incidental, or consequential damages, including loss of profits or data, or business interruption.
Our total liability for any claim shall not exceed the total fees paid in the last month.
We disclaim any responsibility for third-party service interruptions or errors in AI outputs.
AI-generated outputs are informational and should not be considered or relied upon as legal, medical, financial, or professional advice.
10. Acceptable Use & Restrictions
You agree not to use MindSpark AI’s service for illegal, harmful, or discriminatory purposes.
Excessive use or abuse of API limits may result in suspension.
You may not reverse-engineer, tamper with, or attempt to extract source code.
11. Termination
Either party may terminate service at any time with notice if the business relationship ends.
Upon termination, access will be revoked, and data will be transferred to secure storage for compliance or business purposes.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of California, United States.
Any disputes will be resolved in Los Angeles, California.
Mediation or arbitration may be used prior to formal legal proceedings where possible.
13. Changes to Terms
MindSpark AI may amend these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the revised terms.
